EU Deforestation Regulation Largely 'Dismantled' After Initial Fanfare
Originally hailed as a pioneering law that would curb the worldwide crisis of deforestation.
But, the revised version of the European Union's deforestation regulation, once touted as the crown jewel of the Green Deal, has emerged in a severely weakened state, leading to criticism from its initial author and environmental politicians.
"The regulation was stripped," stated the law's original author, citing the exclusion of crucial requirements for downstream traders to check the provenance of products like palm oil, soy, wood, beef, rubber, cocoa and coffee.
He warned that a reduced number of responsible companies, less information collected, and imprecise sourcing details would complicate the task of authorities.
Political Dismantling
Environmental vice-president a leading green politician was more blunt, labeling the postponements, exceptions and new loopholes – such as one for printed products – as the "systematic weakening" of the law.
This outcome stands in stark contrast to the hopes of over 1.2 million European citizens who signed a petition in 2020 demanding a prohibition of goods linked to forest destruction.
When launched in 2021, then-Green Deal commissioner the European commissioner called it "the toughest law proposed to fight forest loss."
From Ambition to Compromise
The law's unravelling is seen by critics as the European Union retreating from its green talk. The proposal encountered two major postponements, ostensibly over IT issues, which drew condemnation.
"By revisiting the legislation instead of solving a technical issue, authorities invited political interference," commented Toussaint.
Originally, the regulation mandated that firms to trace commodities to their specific geographic origin using geolocation data, holding them accountable for deforestation in their supply chains with penalties and hefty fines.
"It wasn't bureaucracy for its own sake," Schally explained. "It was the mechanism that made the rules enforceable, established traceability, and stopped companies from hiding behind opaque production networks."
Mounting Pressure
Yet, the rigorous checks provoked opposition in the EU capital from multinational corporations, producer countries, conservative political groups and member states with forestry industries.
Experts cite last year's EU elections as a turning point, creating a new political majority more skeptical of environmental rules.
"Additional intense pressure has come from big trading partners like the United States," noted expert Andreas Rasche, implying the EU yielded to some demands in trade talks.
Key Loopholes Introduced
The passed law includes several critical weakenings:
- Retailers and traders were largely freed from conducting rigorous checks.
- A new “low risk” category was created.
- A window for further "simplifications" was established for next spring.
- Only four countries – geopolitical adversaries of the EU – will face “high risk” scrutiny.
"Instead of tightening rules for companies, it stripped them back," said the law's author. "By shifting responsibilities to producers, it reduced accountability."
Uncertainty for Companies
The delays and changes have also caused frustration for companies that prepared in advance.
"We feel very annoyed because we put a lot of effort into complying," said a coffee company executive. "We invested in software, followed seminars and built a team... now they’re saying it could be altered again. It’s a major letdown."
The Commission's Stance
A commission spokesperson supported the final law, saying: "We have listened to feedback and acted to ensure a simple, fair and cost-efficient implementation."
