The federal appeals court decided on this week that it would rehear the case concerning the president’s authority with an expanded group of 11 judges. The judicial body also vacated a earlier ruling from a smaller judicial group that had sided with the administration.

This order represents the most recent development in a long-running court case over whether the administration has the authority and valid reason to send state military units in the city. Approximately 200 federalized guard members have been in uncertainty since late September when the deployment effort was started in response to ongoing demonstrations.

The administration has argued that government employees at the immigration center in south Portland were facing threats, while local authorities maintain that municipal police have control of the circumstances.

The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this month – one blocking the federal control of the Oregon national guard, and another prohibiting the deployment of any military personnel in the state, after attempts to circumvent the first order by mobilizing troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of 200 Oregon national guard – but the second ruling remained in place, blocking the actual deployment of the troops.

The latest ruling means the issue will be heard by the full court – with all decisions under consideration simultaneously – by a panel of 11 judges.

“This decision shows that the truth matters and that the judicial system are working to ensure government responsibility. The constitution limits the executive authority, and local populations cannot be treated as a testing site for expansive government power,” said the legal representative in a statement.

“The judicial body is sending a definite signal: the president cannot dispatch the armed forces into American urban areas unnecessarily. We will continue protecting state legislation, values, and autonomy as this legal proceeding progresses and our legal battle continues in the courts.”
